6. The 341 Hearing (Creditors Meeting)
- The sixth step in the Chapter 7 bankruptcy process is the 341 Hearing (also known as the Creditors Meeting), which you must attend in person.
- This hearing is where the Chapter 7 Trustee, who is appointed by the Bankruptcy Court, will ask you questions to make sure that everything on your bankruptcy paperwork is true and correct.
- The Trustee's job is to see if there is any unexempt cash or property that he or she can sell to help pay off your debts.
- Any of your creditors also have the right to come to the hearing and ask you questions as well. Usually, no creditors show up, though.
- Don't worry, your attorney will be right by your side the whole time. We will also send you emails or texts to tell you a little bit more about what to expect at the 341 Hearing. There is also more information on the 341 Hearing on this page of our website.
- After the 341 Hearing, we wait to hear from the Trustee. If all goes well, he or she will issue a "no asset" notice, and 90 days from filing your debts will be discharged.
- If there are assets, creditors are given notice, and the Trustee begins a process to collect the assets and use them to pay off part or all of the debt. We will walk you through this, should it be necessary.
- That is the end of the process! The seventh and last step is the discharge.
