5. Filing
- After you sign your bankruptcy petition at your signing appointment, we will file the paperwork electronically with the court. This is called "Filing."
- Once your case is filed, the "automatic stay" goes into effect, which means that creditors stop calling you completely.
- The filing date is also the date that begins the countdown to your discharge, which happens 90 days from the date your bankruptcy is filed (unless there is an objection).
- You will receive a paper notice from the court after your case is filed, which will tell you the case number, the date the case was filed, the date, time, and location of your Creditors Meeting, and the deadline by which creditors must object to discharge, along with other information.
- The sixth step in the process is your 341 Hearing (also known as the Creditors Meeting).
